These Terms of Service (“Terms”) govern your access to and use of the mobile application and related services (the “App”) operated by Oath or Else (“we,” “us,” or “our”).
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Purpose of the app
Oath or Else provides structured accountability tools that allow users to create commitments, receive reminders, submit evidence of completion, receive pass or fail determinations, and review progress over time.
The App is intended to support personal responsibility and follow-through. It does not guarantee outcomes or results of any kind.
User responsibility
All commitments, goals, and submissions are self-directed. You are solely responsible for the commitments you create and for determining what constitutes completion.
Any actions you take based on use of the App are your responsibility. The App does not replace professional judgment, training, instruction, or supervision.
User judgment and safe use
You acknowledge that you are solely responsible for exercising reasonable judgment when creating commitments, goals, or tasks within the App.
You agree not to use the App to create or pursue commitments that are unsafe, unlawful, extreme, or harmful to yourself or others.
The App does not assess the safety, feasibility, or appropriateness of any commitment. Any reminders, follow-up, pass or fail determinations, or accountability features are provided solely to support follow-through on commitments you voluntarily choose to set.
You understand that you may modify, pause, or discontinue any commitment at any time if circumstances change or if continuing would be unsafe or unreasonable.
No professional advice
The App does not provide medical, legal, fitness, educational, or professional advice.
Use of the App does not establish a professional relationship of any kind. You should seek qualified professionals for medical, legal, or other regulated services.
High-risk activities disclaimer
The App is not intended to be used as guidance or instruction for high-risk activities, including but not limited to physical training beyond personal limits, medical or healthcare decisions, legal actions, professional certification outcomes, emergency response, or any activity that carries inherent risk.
Use of the App does not replace training, supervision, professional instruction, or safety protocols required for any regulated or hazardous activity.
You acknowledge that following through on commitments involving physical, professional, or personal risk is done at your own discretion and responsibility.
Evidence submission
You may submit evidence of completion, including text, images, or other materials (“User Content”).
By submitting User Content, you confirm that you own or have the rights to the content, that it does not violate any laws or third-party rights, and that it does not contain illegal, abusive, or harmful material.
We do not guarantee acceptance of any submission.
Pass or fail determinations
The App may provide pass or fail or completion determinations based on the standards you set.
These determinations are informational only and do not constitute evaluation, certification, or endorsement. They do not guarantee real-world outcomes.
These determinations are part of the accountability system and are not judgments of your character, ability, or worth.
Subscriptions and billing
Some features require a paid subscription.
Subscriptions are billed through Apple’s In-App Purchase system and automatically renew unless canceled. You can manage or cancel subscriptions through your Apple ID
settings.
We do not issue refunds directly. Refunds are handled by Apple according to their policies.
Acceptable use
You agree not to use the App for unlawful purposes, upload false or harmful content, attempt to bypass system limits, interfere with the App’s operation or security, or harass or abuse others.
We reserve the right to suspend or terminate accounts that violate these Terms.

We may suspend or terminate access to the App at our discretion if these Terms are violated, abuse or misuse is detected, or required by law.
Termination does not entitle you to refunds.

Intellectual property
The App, including its content, design, and functionality, is owned by Oath or Else and protected by intellectual property laws.
You may not copy, modify, distribute, or reverse engineer the App without permission.
Disclaimer of warranties
The App is provided “as is” and “as available.”
We make no warranties regarding accuracy, reliability, availability, fitness for a particular purpose, or achievement of outcomes.
Use of the App is at your own risk.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising from use of the App.
Our total liability for any claim will not exceed the amount you paid for the App in the previous twelve months, or zero if you used the App without payment.
No responsibility for user outcomes or decisions
You agree that any outcomes, consequences, or results arising from your use of the App, including physical, emotional, professional, financial, or legal outcomes, are solely your responsibility.
Oath or Else is not responsible for any harm, loss, or damage resulting from commitments you choose to create, actions you take, or decisions you make based on use of the App.
The App does not compel action, enforce behavior, or require completion of any task. All participation is voluntary.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App, your submitted content, or your violation of these Terms.
Changes to these terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of New Mexico, USA, without regard to conflict-of-law principles.
